Terms of Service

These Terms of Service ("Terms") are an agreement between you and Tavelino ("Tavelino", "we", "us") governing the Tavelino mobile application, website, and related services (the "Services"). By downloading, accessing, purchasing, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

Food, allergen, and dietary notice. Recipes, ingredient recognition, translations, and labels such as "vegetarian", "vegan", "dairy-free", "gluten-free", and "nut-free" are generated or classified automatically and may be incomplete or wrong. If you have an allergy, dietary restriction, or medical condition, read every ingredient label and verify suitability yourself before cooking or eating. Tavelino is not a substitute for professional medical, nutritional, or food-safety advice. Use a food thermometer and official safety guidance when appropriate.

Eligibility and store terms

You must be legally able to enter this agreement. If you are below the age of legal majority where you live, a parent or legal guardian must review and accept these Terms for you. Apple and Google may impose additional terms for downloads, purchases, refunds, and use through their stores; those terms also apply where relevant.

Additional Apple App Store terms

If you obtained the App through Apple's App Store, these Terms are between you and Tavelino, not Apple. The license is limited to use of the App on Apple-branded products you own or control as permitted by the App Store Usage Rules, including any permitted Family Sharing or volume-purchase use. Apple has no obligation to provide maintenance or support for the App.

To the extent any applicable warranty cannot be disclaimed, you may notify Apple and Apple may refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. Tavelino, not Apple, is responsible for addressing claims about the App, including product liability, legal or regulatory compliance, consumer-protection claims, and intellectual-property infringement claims. You represent that you are not located in a country subject to a U.S. Government embargo and are not listed on a U.S. Government prohibited or restricted-party list. You must comply with applicable third-party terms. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these App Store-specific provisions.

License and anonymous access

We grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to use the App for lawful, non-commercial cooking purposes. Tavelino does not require a named account, but creates an anonymous identifier to authenticate the App, remember entitlements, and enforce limits. You are responsible for activity from your device and for keeping it secure. Reinstalling or clearing app data may remove locally stored recipes, lists, photos, progress, and access to anonymous records that cannot otherwise be linked back to you.

Acceptable use

You must not, and must not help anyone else to:

break the law, infringe rights, or use the Services to harm, threaten, or deceive others;
bypass subscriptions, authentication, rate limits, spending controls, regional controls, or other safeguards;
probe, scrape, overload, automate access to, reverse engineer, or disrupt the Services except where applicable law expressly permits it;
upload malicious code, unlawful material, or content you do not have the right to submit; or
use the Services or their output to build or train a competing model, dataset, recipe catalog, or commercial service without our written permission.

We may limit, suspend, or terminate access when reasonably necessary to protect users, providers, rights holders, or the Services; investigate suspected misuse; comply with law; or enforce these Terms.

Subscriptions and purchases

Some Services are free and supported by advertising. Optional purchases or subscriptions may remove ads and unlock premium features such as the Sous Chef voice companion. The price, billing period, trial (if any), included benefits, and any automatic-renewal terms are shown before purchase. Apple or Google bills your store account. An auto-renewing subscription continues until cancelled through that store, subject to the store's cancellation deadline and terms. Deleting the App does not cancel a subscription.

Refunds are handled by Apple or Google under their store policies; we cannot issue store refunds directly. Statutory refund rights, if any, are not limited by this paragraph.

Fair use and usage limits

Some features use paid third-party AI, voice, vision, and search services. Premium AI and live-search features are provided on a fair-use basis and are subject to per-user call, cost, rate, and security limits. If you reach a limit, that feature may pause until the displayed or applicable reset period while other features continue to work. Limits may differ by feature, plan, region, provider availability, and abuse risk.

Not an unlimited service. Paid upgrades unlock identified premium features; they are not sold as unlimited or unmetered AI use. Reaching a disclosed fair-use limit is expected behavior and does not by itself create a refund right. We may adjust reasonable limits to keep the service secure and sustainable, but will not use this term to override non-waivable consumer rights.

AI output and recipe safety

Ingredient recognition, translations, dietary labels, recipe matches, and Sous Chef replies can be inaccurate, incomplete, outdated, or unsuitable for you. They are tools for general cooking assistance, not guarantees or professional advice. Check package labels, allergens, cross-contamination, freshness, storage, cooking temperatures, equipment safety, and recipe quantities yourself. Stop and use trusted official guidance if an instruction appears unsafe. Do not rely on Tavelino in an emergency.

Your content

You retain ownership of photos, text, and other content you submit. You grant Tavelino a limited, worldwide license to host, transmit, process, adapt, and display that content only as reasonably necessary to operate, secure, and improve the requested Services. You represent that you have the necessary rights to submit it. Most saved recipes, lists, cooking progress, and completed-dish photos are kept locally on your device; you are responsible for your own backups.

Tavelino and recipe content

The App, branding, interface, software, and original materials belong to Tavelino or its licensors. Recipe facts and instructions may come from publicly available publishers and are presented with source credit and a link where available. Recipe photographs, editorial expression, trademarks, and related publisher materials remain the property of their respective owners; Tavelino does not claim ownership of them. If you are a rights holder and believe content is misattributed or should be removed, email [email protected] with the work, source URL, Tavelino location, your contact details, and the basis for your request. We will review complete, good-faith notices promptly.

Third-party services and links

The Services depend on independent providers for AI, hosting, search, advertising, purchases, recipe sources, and other functions. Their terms and privacy notices may apply. We do not control third-party sites, content, availability, or conduct, and a link or integration is not an endorsement. Features may change or become unavailable when a provider changes its service.

Service changes and availability

We may update, improve, discontinue, or restrict a feature, including to address security, legal, provider, or sustainability requirements. We do not promise that every recipe, source, device, language, or feature will always be available or error-free. Where required, we will provide notice or a remedy for a material change to a paid service.

Disclaimers

To the maximum extent permitted by law, the Services are provided "as is" and "as available". Tavelino disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and accuracy. This does not exclude warranties or rights that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by law, Tavelino and its service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; loss of data, profits, or goodwill; or harm caused by reliance on ingredient recognition, recipes, dietary labels, AI output, or third-party content. Nothing in these Terms limits liability that cannot lawfully be limited, including applicable liability for fraud, willful misconduct, death, or personal injury.

Responsibility for claims

To the extent permitted by law, you will be responsible for losses and reasonable costs arising from your unlawful content, material breach of these Terms, or intentional misuse of the Services. This section does not apply where prohibited by consumer law.

Applicable law and disputes

These Terms are governed by applicable law, without depriving you of mandatory protections available in your country of residence. Before filing a formal claim, please contact [email protected] so we can try to resolve it informally. You may bring a claim in any court or forum available under applicable law. We do not require private arbitration or waive class-action rights in these Terms.

Changes

We may update these Terms for new features, security, law, or business changes. We will change the date above and provide additional notice when a change is material and notice is required. Changes apply prospectively.

General

If part of these Terms is unenforceable, the remaining provisions remain in effect. A delay in enforcing a term is not a waiver. You may not transfer this agreement without our consent; we may transfer it as part of a reorganization or sale, subject to applicable law. These Terms and the referenced policies are the entire agreement about the Services.
